PRIVACY POLICY
Through this notice, “Nàutic Palamós, SA” (hereinafter “Marina Palamós”), informs users of the website www.marinapalamos.com, in compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 (General Data Protection Regulation) and Organic Law 3/18 of December 5 on the Protection of Personal Data and guarantee of digital rights and other applicable regulations, of its personal data protection policy so that users may expressly, freely and voluntarily decide to provide “Marina Palamós” with the personal data requested due to a request for information or for the contracting and management of the various products and services related to marina facilities and activities ancillary to maritime transport and inland waterways.
Unless expressly stated otherwise, it shall be considered necessary to complete all required fields in the form or similar document truthfully, accurately, completely and up to date. Otherwise, “Marina Palamós” may, depending on the case, not proceed with user registration or deny the specific service requested. All data provided by the user/data subject will be processed according to the details set out below.

Identification of the Data Protection Officer: For all matters relating to personal data, such as queries, requests, suggestions, etc., you may contact the Data Protection Officer designated by “Marina Palamós” through the following email address administracio@marinapalamos.com [indicate if there is a name, telephone number or additional contact details].
Purpose of processing:
All data provided will be processed for the following purposes:
- To respond to requests made by the data subject.
- Maintenance of any relationship that may be established.
- Management, administration, information, provision and improvement of the services that are contracted.
- Commercial communications related to our products and services.
The personal data provided will be retained while the commercial relationship is maintained, the data subject does not request its deletion or it is necessary for the purposes of the processing. Data shall not be deleted where there is a legal provision requiring its retention, in which case the data will be blocked and kept only at the disposal of Public Administrations, Judges and Courts, for the handling of any liabilities arising from the processing, during the limitation period thereof.
Currently, no automated decisions are carried out, including profiling, based on your personal data. In the event that such automated decisions are carried out in the future, prior consent will be obtained.
Legal basis for processing:
All processing carried out on your personal data has been previously and expressly consented to by you. Prior to this, you are informed of all the aspects required by law so that you may give informed consent.
You may revoke this consent at any time as detailed later in this document.
Recipients, disclosures and data transfers:
Your data will not be disclosed to third parties, except when it is essential for the provision of the service or due to legal obligation.
Likewise, your data will not be transferred to countries outside the European Union unless it is essential for the fulfillment of the purposes and you authorize it previously and expressly.
Rights of data subjects:

The request must include name, surname and documentation proving the identity of the data subject or their legal representative, as well as document proving the representation, the request specifying the application, address for notification purposes, date and signature of the applicant and supporting documents for the request made. If the request does not meet the specified requirements, its correction will be requested.
The rights of data subjects are: access, rectification, restriction, portability, objection and erasure; and their definition is:
Right of access:
The data subject shall have the right to obtain from the controller confirmation as to whether or not personal data concerning him or her are being processed and, where that is the case, access to the personal data and the following information:
a) the purposes of the processing
b) the categories of personal data concerned
c) the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations
d) where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period
e) the existence of the right to request from the controller rectification or erasure of personal data or restriction of processing of personal data concerning the data subject or to object to such processing
f) the right to lodge a complaint with a supervisory authority
g) where the personal data are not collected from the data subject, any available information as to their source
h) the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4), and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject.
When personal data are transferred to a third country or to an international organisation, the data subject shall have the right to be informed of the appropriate safeguards pursuant to Article 46 relating to the transfer. The controller shall provide a copy of the personal data undergoing processing. The controller may charge a reasonable fee based on administrative costs for any additional copies requested by the data subject. Where the data subject makes the request by electronic means, and unless otherwise requested, the information shall be provided in a commonly used electronic form.
Right of rectification:
The data subject shall have the right to obtain without undue delay from the controller the rectification of inaccurate personal data concerning him or her. Taking into account the purposes of the processing, the data subject shall have the right to have incomplete personal data completed, including by means of providing a supplementary statement.
Right of erasure:
The data subject shall have the right to obtain without undue delay from the controller the erasure of personal data concerning him or her, and the controller shall have the obligation to erase personal data without undue delay where one of the following grounds applies:
a) the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed
b) the data subject withdraws consent on which the processing is based and where there is no other legal ground for the processing
c) the data subject objects to the processing and there are no overriding legitimate grounds for the processing
d) the personal data have been unlawfully processed
e) the personal data must be erased for compliance with a legal obligation
f) the personal data have been collected in relation to the offer of information society services
When the controller has made the personal data public and is obliged to erase the data, the controller shall take reasonable steps to inform other controllers processing the data.
This right shall be limited by other rights such as freedom of expression and information, compliance with legal obligations or public interest.
Right to restriction of processing:
The data subject shall have the right to obtain restriction of processing where one of the following applies:
a) the accuracy of the personal data is contested
b) the processing is unlawful and the data subject opposes erasure
c) the controller no longer needs the data but they are required for legal claims
d) the data subject has objected pending verification
Right of objection:
The data subject shall have the right to object at any time to the processing of personal data.
Right to data portability:
The data subject shall have the right to receive personal data in a structured format and transmit it to another controller.
The controller shall communicate any rectification, erasure or restriction of processing to recipients unless impossible or disproportionate.
Revocation of consent: The data subject may withdraw consent at any time.
The data subject shall have the right to lodge a complaint with the supervisory authority.
Security measures: The controller has adopted the necessary technical and organisational measures.
